Shehata & Partners Secured a Favourable Decision for a Bulgarian Investment Banking Boutique in a Debt Collection Dispute

Cairo, Egypt – 6 October 2024 – S&P successfully appealed a decision by the Cairo Court of Appeal to enforce an arbitral award in Egypt. The award was issued by the Cairo Regional Centre for International Commercial Arbitration in favor of a Bulgarian client against an Egyptian company. The original court decision had dismissed the case, claiming it lacked jurisdiction over international commercial disputes.

However, the Court of Appeal overturned this decision, ruling that the dispute was indeed international and that the court had the authority to enforce the arbitral award. The court emphasized that the judge’s role is limited to following the specific legal provisions and cannot impose additional conditions or forms; Thus, The Court of Appeal found that the original decision violated these principles and declared it null and void.

In conclusion, the ruling affirms the jurisdiction of the Cairo Court of Appeal to enforce international arbitral awards and highlights the importance of adhering to legal procedures in such cases.
